Please read these Terms of Service ("Terms", "ToS") carefully before using our website, accessing our courses, or enrolling in our training programs. By accessing or using any part of the website, you agree to be bound by these Terms. If you do not agree to all the terms and conditions of this agreement, you may not access the website or use any services.
- Age Requirement: By agreeing to these Terms, you represent that you are at least 18 years of age, or that you have given us your consent to allow any of your minor dependents to use this site.
- Communications: By creating an Account on our service, you agree to subscribe to newsletters, marketing or promotional materials, and other training information we may send. You may opt out of receiving any or all of these communications by following the unsubscribe link or instructions provided in any email we send.
- Account Accuracy: You agree to provide accurate, current, and complete information when creating your Account and to update such information as necessary to keep it accurate.
- Account Security: You are entirely responsible for maintaining the confidentiality of your Account credentials and password. You agree not to share, sell, or transfer your login details to any third party.
- Unauthorised Use: You must notify us immediately at contact@nimbull.com if you suspect any unauthorised use or breach of security regarding your account.
3.1 Free Access vs. Premium Paid Content
Nimbull.ai operates on a freemium model. We offer select initial courses, introductory training modules, and platform access free of charge ("Free Services"). We reserve the right to limit, modify, or change the scope of Free Services at any time without notice.
To unlock advanced courses, certifications, specialized training, or ongoing platform access ("Premium Services"), you will be required to purchase a subscription or pay a one-off course fee. You agree that access to Premium Services is strictly contingent upon your payment of all applicable fees.
3.2 Billing Information
If you wish to purchase any Premium Services made available through the Service (“Purchase”), you may be asked to supply information relevant to your Purchase including, without limitation, your credit card number, expiration date, billing address, and contact information.
3.3 Representations & Processors
You represent and warrant that you have the legal right to use any credit card(s) or payment method(s) utilized, and that the information you supply is true, correct, and complete. We utilize secure third-party payment gateways (e.g., Stripe, PayPal) to process payments. By submitting your information, you grant us the right to provide this data to these third parties subject to our Privacy Policy.
3.4 Order Cancellation
We reserve the right to refuse or cancel your order at any time for reasons including but not limited to: product or service availability, errors in the description or price of the training, errors in your order, or suspicion of fraud or an unauthorised transaction.
- Recurring Subscriptions: If you select a Premium Service with an auto-renewal feature, you authorise Nimbull to automatically maintain your account information and charge that payment method upon renewal with no further action required by you.
- Price Adjustments: We may change the price for Recurring Subscriptions from time to time. Any price changes will be communicated to you in advance. Price changes will take effect at the start of the next billing cycle. Continuing to use the Service after the change constitutes acceptance of the new price.
- Cancellation: You may cancel your subscription at any time via your Account Settings dashboard or by contacting contact@nimbull.com. If you cancel prior to the end of your current billing cycle, you will retain access to the premium training materials until the end of that period. No partial refunds are issued for unused days in a cycle.
- Satisfaction Guarantee: Nimbull protects your initial premium enrollment with a 14-Day Satisfaction Guarantee unless explicitly stated otherwise at checkout. If you are unsatisfied with a course, you may request a refund within 14 days of your initial purchase by contacting contact@nimbull.com.
- Exemptions: Subsequent monthly subscription charges or recurring rebills are exempt from the 14-day refund window. Free Services are not eligible for refunds or financial compensation of any kind.
- Abuse Policy: Refunds are not available for accounts that have violated these Terms of Service. If Nimbull determines, in its sole discretion, that a user is abusing our refund policy, we reserve the right to suspend the account and refuse future service.
Our Property: All content, modules, videos, documents, prompt engineering templates, source code, text, graphics, and logos displayed on Nimbull.ai are the exclusive intellectual property of Nimbull PTY LTD and are protected by copyright, trademark, and other intellectual property laws.
Limited License: Whether accessing Free Services or Premium Services, you are granted a limited, non-exclusive, non-transferable, revocable license to view and use the materials for your personal or internal business training.
Prohibited Uses: You strictly agree not to:
- Copy, redistribute, resell, share login access, or broadcast any Nimbull training materials.
- Use our materials, frameworks, or proprietary methods to create a competing education platform or AI consulting course.
- Use automated scraping tools or bots to extract data or video modules from our platform.
When using our systems, discussion forums, or communities, you agree not to submit or transmit any content that:
- Is unlawful, abusive, threatening, harassing, defamatory, or discriminatory.
- Contains or introduces software viruses, malware, or malicious code designed to disrupt the functionality of the Website.
- Impersonates other people, including Nimbull employees, instructors, or representatives.
- Constitutes unauthorised advertising, spam, or unsolicited mass communications.
"As-Is" Service: Artificial Intelligence tools, models, and best practices evolve rapidly. Nimbull provides its educational services on an "as-is" and "as-available" basis. While we strive for accuracy, we do not warrant that the training methods, prompt outcomes, or AI tools discussed will always be error-free, uninterrupted, or applicable to every unique corporate environment.
No Guarantee of Results: You acknowledge that Nimbull makes no guarantees regarding specific career advancement, revenue increases, or technological performance resulting from taking our courses.
Limitation of Liability: To the maximum extent permitted by applicable law, Nimbull PTY LTD, its directors, employees, or partners shall not be liable for any indirect, incidental, special, or consequential damages—including loss of profits, data, or business opportunities—arising out of your use or inability to use our platform or the AI tools taught within it.
You agree to indemnify, defend, and hold harmless Nimbull PTY LTD and our affiliates, partners, officers, and employees from any claim or demand, including reasonable legal fees, made by any third party due to or arising out of your breach of these Terms of Service, or your violation of any law or the rights of a third party.
These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of New South Wales, Australia, without regard to conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts located in Sydney, NSW to resolve any legal matter arising from these Terms.
We reserve the right, at our sole discretion, to update, change, or replace any part of these Terms of Service by posting updates and changes to our website. It is your responsibility to check our website periodically for changes. Your continued use of or access to our website or the Service following the posting of any changes to these Terms of Service constitutes acceptance of those changes.
